These Terms of Service (“Terms”) are the agreement between you and Rubytee, 6085 Hogan Dam Road, Valley Springs, CA 95252, United States (“Rubytee”, “we”, “us”), for your use of rubytee.com and any purchase you make from us. By browsing the site or placing an order, you agree to these Terms and to the policies they refer to. We have tried to write them in plain English. Nothing in these Terms takes away rights you have under consumer protection laws that cannot be waived by contract.

1. Who can use the site
You may use rubytee.com to browse and buy T-shirts for personal use, including as gifts. To place an order you must be old enough to enter into a binding contract where you live, or have a parent’s or guardian’s permission. If you create an account, you are responsible for keeping your login details secure and for activity on your account; tell us straight away if you think someone else has used it. We may suspend an account that is used to break these Terms.
2. Our products and how we describe them
Rubytee sells printed and plain T-shirts, including short sleeve, long sleeve, tank top and V-neck styles, in sizes S to 5XL. We aim to describe and photograph every product accurately: the design, the garment style, the available colors and sizes, and any care instructions. A few things are worth knowing:
- Colors can look slightly different on different screens, and fabric shades can vary a little between production batches.
- Some product images may be digital previews that show how a design is placed on the shirt; the printed result can vary slightly in exact position and size.
- Garment measurements are published in our Size Guide. Measurements are taken flat and can vary by a small tolerance from shirt to shirt.
If a shirt you receive is materially different from its description, you are covered by our Refund Policy and Returns & Exchanges Policy.
3. Prices
All prices are shown in US dollars. Prices can change at any time before you place an order, but the price shown in your cart at the moment you check out is the price you pay. Shipping to our four destination countries is free. Sales taxes, where they apply, are calculated and shown at checkout. Orders delivered outside the United States may be charged import duties or taxes by the destination country; these are collected by the carrier or customs authority, not by us, as explained in Shipping & Delivery.
If a product is displayed at an obviously incorrect price because of a technical or typing error, we are not required to sell it at that price. We will contact you before shipping and either correct the order with your agreement or cancel it and refund you in full within 7 calendar days.
4. Placing an order and when the contract is formed
When you click to place your order, you make an offer to buy the items in your cart. We accept your offer when we send the order confirmation email, and a contract is formed at that point. We may decline or cancel an order before shipping if a design or size is unavailable, if we cannot verify the payment, if the delivery address is outside the countries we ship to, if we reasonably suspect fraud, or if the order breaks these Terms. If we cancel, we refund any amount you paid in full.
Group orders and multiple-shirt orders are treated as one contract for all the items listed in the confirmation, but each shirt can be returned or exchanged individually under our returns policy.
5. Payment
You agree to pay the total shown at checkout using one of the payment methods offered on the checkout page at the time of your order. Payments are processed by a third-party payment provider; Rubytee does not receive or store your full card number. More details are on our Payment Methods page. If a payment is reversed or charged back without a valid reason, we may suspend future orders from the account concerned.
6. Shipping, delivery and risk
We ship to the United States, Canada, Australia and New Zealand from the USA. Orders are usually prepared within 1–3 business days and typically spend 3–7 business days in transit. Delivery dates are estimates, not guarantees. We remain responsible for your order until it is delivered to the address you gave us: if it is lost or damaged in transit, we replace it or refund you as described in Shipping & Delivery. Please make sure the address you enter is complete and correct.
7. Returns, refunds and cancellations
You can return or exchange any product within 60 days of delivery under our Returns & Exchanges Policy. Approved refunds are processed to your original payment method within 7 calendar days under our Refund Policy. You can cancel or change an order free of charge within 24 hours, as long as it has not shipped, as described in Cancel or Change an Order. These three policies form part of these Terms.
8. Discount codes and promotions
From time to time we may offer discount codes or promotions. Each one applies only according to its stated terms, such as the products covered, the expiry date and any minimum spend. Codes have no cash value, cannot be exchanged for money and normally cannot be combined unless we say so. We may end a promotion at any time, but ending it never affects an order you have already placed. If you return items bought with a discount, the refund reflects the price you actually paid.
9. Reviews, photos and other content you send us
If you post a review, upload a photo or send us other content, you confirm that it is honest, based on your own experience, lawful, and that you have the right to share it. You give Rubytee a non-exclusive, royalty-free, worldwide licence to display, reproduce and adapt that content on our site and in our marketing, with credit where appropriate. We do not pay for reviews and we do not edit reviews to change their meaning. We may remove content that is false, offensive, unrelated to the product, contains personal information or infringes someone else’s rights.
10. Intellectual property
The content of rubytee.com, including the Rubytee name and logo, our original T-shirt designs and artwork, product photographs, product descriptions, page text, graphics and site layout, belongs to Rubytee or our licensors and is protected by copyright, trademark and other laws. Buying a shirt gives you ownership of that physical shirt; it does not give you any right to reproduce the design on other products or to sell copies. 11. Acceptable use
You agree not to misuse the site. In particular, you must not try to gain unauthorized access to the site or its systems, interfere with its security or performance, scrape or copy content with automated tools (other than normal search engine indexing), place fraudulent orders, use someone else’s payment details without permission, harass other customers or our staff, or use the site for any unlawful purpose.
12. Links to other websites
The site may contain links to third-party websites, such as a carrier’s tracking page. We are not responsible for the content or privacy practices of those sites, and a link does not mean we endorse them.
13. Availability of the site
We work to keep rubytee.com available and accurate, but we cannot promise that it will always be available, uninterrupted or free of errors. We may update, suspend or change parts of the site, including products and prices, at any time.
14. Disclaimers and limitation of liability
To the extent permitted by law, the site is provided “as is”, and we exclude implied warranties that can lawfully be excluded. We are not liable for indirect or consequential losses, such as loss of profit or opportunity, arising from your use of the site or your purchase. Our total liability for any order is limited to the amount you paid for that order. These limits do not apply to liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence, and they do not affect your statutory rights as a consumer, including the consumer guarantees that apply in Australia and New Zealand.
15. Indemnity
If you break these Terms, for example by submitting content that infringes someone’s rights or by misusing the site, you agree to cover reasonable losses and costs that Rubytee incurs as a direct result, to the extent permitted by law.
16. Governing law and disputes
These Terms are governed by the laws that apply where Rubytee is established, without limiting any mandatory consumer protection law of the country where you live. If you have a problem with an order, please contact us first at support@rubytee.com. Most issues are resolved quickly by email, and we will always try to find a fair solution before either of us takes any formal step.
17. Changes to these Terms
We may update these Terms from time to time. The version published when you place an order applies to that order. The date at the top shows the most recent change, and continued use of the site after a change means you accept the updated Terms for future use and orders.
18. Emails and communications
By placing an order you agree that we may send you transactional emails about it, such as the order confirmation, shipping and tracking updates, and messages about returns, refunds or problems with delivery. These are part of providing the service and are not marketing. We only send marketing emails if you have agreed to receive them, and you can unsubscribe at any time using the link in each message. Notices we send to the email address on your order or account are treated as received.
19. General
If any part of these Terms is found to be unenforceable, the rest remains in effect. If we do not enforce a right straight away, we can still enforce it later. These Terms, together with the policies they refer to, are the entire agreement between you and Rubytee about your use of the site and your purchases.
